It’s understood that all parties including the employer and contractor whom are affected by the COVID-19 pandemic is ultimately still required to comply with all their contractual obligations under a contract. Despite each project being unique in its product and circumstances, the risk allocation and change management standards and key concepts still remain the same in which most of the organizations lack to implement, resulting in the root cause of disputes between the employers and contractors during the COVID-19 pandemic. As many of the employers and contractors are claiming delays, disruptions and cost overrun to mitigate the effect of COVID-19 pandemic without clear understanding of risk allocation, change management, crisis management and even without understanding of the contracts provisions that support the treatment of such pandemics. This Keynote will address all of the above related issues and discuss solutions and best practices for the same.

It is reasonably apparent that the progress of the work in construction projects is likely to be delayed due to COVID-19 pandemic’s proliferation and its negative implications. Contractors are unable to estimate the total delay at this current stage of the project as its continuing. When the delay is over, most of the contractors are intending to submit the required estimates and other details of the project disruptions. In response to the unexpected delay, most contractors are requesting an interim extension of time at this time in response to the COVID-19 delays and impacts which considerably a source for disputes between employers & contractors.
In this regard the all concerned contractors are working hardly to prove the impacts of COVID-19 on their project performance as a way to get affordable compensation even if their projects were slightly affected. Due to that disputes between the contractors and employers will take place, due to lack of risk allocations in construction contracts and lack of maturity level of change management between the employers and contractors.
